Terms of Service
1. The gist
FreeFax (the “App”, “Service”) lets you send fax transmissions from your iPhone to USA and Canadian destinations. The Service is operated by Joel Foster (d/b/a “FreeFax”, “we”, “us”). By creating an account, you agree to these Terms.
2. Eligibility
- You must be at least 18 years old.
- You must be located in the USA or Canada.
- You must have the right to send the documents you submit to the recipient you specify.
3. Your account
- FreeFax operates anonymously by default. You may optionally sign in with Apple to back up your credit balance and fax history across devices.
- You are responsible for activity that occurs under your device or account.
- If you have signed in with Apple, you may delete your account at any time from the account menu.
4. Credits
- One credit equals one outbound fax page.
- Credits are earned by (a) completing rewarded video ads, (b) purchasing in-app credit packs, or (c) receiving a promotional grant from us.
- Credits are non-refundable, non-transferable, have no cash value, and expire when you delete your account.
- We may, at our discretion, reverse credit grants obtained through fraud, exploitation of bugs, or chargeback reversal.
5. In-app purchases
- In-app purchases are handled by Apple under Apple’s standard Media Services Terms.
- Refund requests go to Apple, not to us. You can request refunds at reportaproblem.apple.com.
- If Apple refunds a purchase and notifies us, we will deduct the corresponding credits from your balance. If your balance has already been spent, it may go negative; we will not send new faxes until it returns to zero or above.
- Prices are set in the App Store listing. Taxes are Apple’s responsibility to collect.
6. Rewarded ads
- Watching an ad grants credits via Google AdMob Server-Side Verification. If AdMob does not confirm the reward, we do not grant credits.
- Excessive or automated ad watching may result in credits being withheld or your account being suspended, at our discretion and at AdMob’s discretion. We may also enforce a daily cap on ad-earned credits.
7. Acceptable use
You agree not to use FreeFax to send:
- Content that is illegal in the USA, in Canada, or in the recipient’s state or province, including fraud, harassment, or child sexual abuse material.
- Unsolicited commercial fax advertisements in violation of the USA Telephone Consumer Protection Act (“TCPA”), 47 U.S.C. § 227, and the Junk Fax Prevention Act.
- Unsolicited commercial fax advertisements in violation of the Canadian Radio-television and Telecommunications Commission’s (“CRTC”) Unsolicited Telecommunications Rules, including any communication directed to a number on Canada’s National Do Not Call List.
- Communications the recipient has opted out of.
- Content that infringes the intellectual property rights of others.
You are solely responsible for compliance with TCPA, the CRTC Unsolicited Telecommunications Rules, HIPAA / PHIPA (if you transmit protected health information), and any other law that applies to the content you transmit. FreeFax automatically inserts a fax header on every page (date, time, sender identity, originating number) that meets the TCPA disclosure requirements; this is the minimum USA law requires and is not legal advice in either jurisdiction.
8. USA and Canada only
FreeFax supports sending to USA and Canadian destinations only — any 10-digit number in the North American Numbering Plan with a USA or Canadian area code. Attempts to send to other countries will fail.
9. No warranty of delivery
Fax is a 1960s protocol that rides on analog phone lines. Delivery failures are common and outside our control. We do not guarantee:
- That any specific fax will be delivered.
- That the recipient’s machine is online, has paper, or is configured correctly.
- That transmissions will be free from errors or delays.
If a transmission fails and we report it as failed, the credit that would have been spent is refunded to your balance.
10. Service availability
We aim for high uptime but do not guarantee uninterrupted service. Maintenance, carrier outages, and force majeure may cause interruptions.
11. Termination
We may suspend or terminate your account, with or without notice, if you (a) violate these Terms, (b) are suspected of fraud, (c) cause harm to other users or to us, or (d) in response to a legal request.
12. Disclaimer of warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
13. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU HAVE PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) USD $50. IN NO EVENT SHALL WE BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS OR LOST DATA.
14. Indemnity
You agree to indemnify and hold us harmless from any claim, demand, loss, or expense (including reasonable attorneys’ fees) arising from (a) your use of the Service, (b) your breach of these Terms, (c) your violation of any law, or (d) your infringement of another person’s rights.
15. Governing law and disputes
These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules. The exclusive forum for disputes is the state and federal courts located in New York, and you consent to personal jurisdiction there. YOU WAIVE ANY RIGHT TO A JURY TRIAL.
16. Changes
We may update these Terms. Material changes will be surfaced in-app. Continued use after a change constitutes acceptance.
